No. 29 CHC Rejected C.R.M.(A) 361 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Sagarpara Police Station Case No. 14 of 2024 dated 13.01.2024 under Sections 21(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

And In the matter of : Palash Roy @ Palas Roy ...... petitioner Mr. Arnab Chatterjee, Ms. Dhanasree Biswas, Ms. Poulami Bose ....for the petitioner Mr. Iqbal Kabir ....for the State Co-accused's prayer for anticipatory bail were rejected on February 13, 2024 passed in C.R.M.(A) 485 of 2024 and on February 22, 2024 passed in C.R.M.(A) 592 of 2024. Petitioner stands on the same footing as that of other coaccused. Independent witnesses implicate the petitioner with the seized commercial quantity of narcotics.

Consequently, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the N.D.P.S. Act, 1985.

This application for anticipatory bail is, thus, rejected. CRM(A) 361 of 2024 is disposed of.
