None appears for the writ petitioner, despite notice.
The notices shown to this court, show that due notice had already been served both on the learned advocate on record for the petitioner on email and also upon the petitioner on email. This order shall be effected subject to filing affidavit-of-service by the applicant in course of the day.
This is an application seeking certain modification in the order dated March 10, 2025 annexure-A at page 12 to the writ petition.
On the joint submissions made by the learned counsel appearing for the parties the following modifications are made:
(i) In the last paragraph of the first page of the order dated March 10, 2025 the expression Executive Engineer shall be read and understood as the Executive Engineer, PWD, Howrah Division; and (ii) Wherever in the order dated March 10, the expression appears as Commissioner Howrah Municipal Corporation and District Magistrate Howrah the same shall be replaced by the jurisdictional Sub-Divisional Officer, Howrah Sadar.
The rest of the order dated March 10, 2025 stands unaltered and without modification save and except that the time stipulation mentioned in the said order dated March 10, 2025 shall remain same but shall reckon from the communication of today's order. Accordingly, CAN 1 of 2025 stands disposed of, without any order as to costs.
