The petitioner is aggrieved by absence of investigation into Gopalnagar Police Station FIR No.822 of 2021 dated 31st December, 2021 under Section 420 of the IPC.

The investigating officer is personally present in Court. It is submitted that the accused did not cooperate first but subsequently did so. Several raids were conducted.

Let the investigation into the aforesaid FIR be completed within a period of one month from date mandatorily and positively.

This Court notes that the matter has been listed under the heading "Senior Citizen", which relates to the rights of Senior Citizens under Article 21 of the Constitution of India. This Court sees that this matter is purely commercial in nature and in no way related to a senior citizen's right under Article 21 of the Constitution of India.

The petitioner shall pay costs assessed at Rs.5,100/- to the High Court Legal Services Authority. It is only upon production of evidence of payment of

costs, that the aforesaid directions on the investigating officer shall be complied with.

The writ petition shall stand disposed of.

The report of the Officer-in-Charge, Gopalnagar Police Station, Bongaon Police District dated 28th February, 2023 is taken on record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
