Mr. Bidyut Kumar Ray Ms. Monisha Sharma .....For the State The present revisional application relates to order dated 27.07.2012 passed by the Learned Additional Chief Judicial Magistrate, Uluberia, Howrah in G.R. Case No.322 of 2007 arising out of Uluberia P.S. Case No.131/07 dated 16.04.2007. The order dated 27.07.2012 reflects that as the witnesses were not present and they refused summons, warrant of arrest was issued in respect of charge-sheeted witness no.2 and summons were issued in respect of charge-sheet witness nos.3 and 4 by order dated 13.12.2011 which was reiterated in the order dated 27.07.2012.

Having regard to the nature of the order which was passed in view of absence of the witness, I do not find any illegality in the order so passed by the Learned Trial Court.

No interference is called for.

Accordingly, CRR 42 of 2013 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
