W.P.A. 2248 of 2023 (Amar Shaw vs. State of West Bengal & Ors.) Mr. Barun Kr. Samanta .... For the Petitioner Mr. Amal Kr. Sen .... For the State Affidavit of service filed on behalf of the petitioner is taken on record.

The petitioner made an application for stage carriage permit before the concerned authority along with prescribed fees which, according to the petitioner, was not accepted by the authority. Learned counsel for the petitioner submits that during pendency of the writ petition the application has been accepted by the authority and is pending consideration. The petitioner has also deposited the prescribed fees along with the application. The petitioner prays for a direction upon the authority to consider the application at the earliest. It is submitted on behalf of the respondents that the 2nd respondent be directed to consider the application, in accordance with law.

In view of the above, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the application submitted by the petitioner within two months from the date of communication of this order upon affording reasonable opportunity of hearing to all the interested persons including the petitioner and other applicants for the route in question, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
