W.P.A. 2258 of 2023 (Jalal Biswas vs. State of West Bengal & Ors.) Mr. Barun Kr. Samanta .... For the Petitioner Mr. Amal Kr. Sen .... For the State Affidavit of service filed on behalf of the petitioner is taken on record.

The petitioner complains that the application for grant of stage carriage permit in his favour has not been accepted by the authority, far less considered. It is submitted on behalf of the respondents that the third respondent be directed to accept the application along with prescribed fees which shall be considered by the 2nd respondent, in accordance with law.

In view of the above, the writ petition is disposed of directing the third respondent to accept the application made by the petitioner along with prescribed fees for the same within one week from date. The said respondent shall make over the application to the 2nd respondent who shall consider and dispose of the same

within six weeks from the date of receipt thereof upon affording reasonable opportunity of hearing to all the interested persons including the petitioner and the other applicants for the route in question, if any, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
