The State of West Bengal & Ors.

Mr. Saswata Gopal Mukherjee, ld P.P., Ms. Sreyashee Biswas.

for the State In this revision the petitioner has challenged the order dated 21st August, 2015 passed in Criminal Revision Case No. 42 of 2014 by Additional Session Judge, 1st Court at Sealdah. By dint of the impugned order the First Appellate Court has set aside the order of the Magistrate dated 22nd July, 2014 and also dismissed the Complaint Case No. 801 of 2012. Complaint Case No. 801 of 2012 was lodged on the basis of the FIR dated 16th September, 2012. Allegedly the petitioner along with other accused persons assembled with fire weapons and other weapons though later on were disbursed due to intervention of the local people. In this case, pending since 2016, no one is appearing for the petitioner in spite of issuance of administrative notice. Ms.

Biswas, learned Advocate who was appointed by the Court to represent the State, is present in Court today, at the time of call. She has supported the impugned order and urges that no interference to the same is warranted in this revision.

inherent jurisdiction of this Court under section 482 CrPC. Hence, in my considered opinion the revision is liable to be dismissed. Criminal Revision being CRR 3 of 2016 is dismissed. All pending applications, if any, are consequently disposed of. Certified website copies of this order, if applied for, be supplied to the parties subject to compliance with all the requisite formalities. ---x--- by RAI CHATTOPADHY AY Date: 2023.03.16 16:57:34 +05'30'
