C.R.M. (A) 646 of 2022 24.03.2022 Sl. 198 Court No.29 sourav (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 07.02.2022 in connection with Harishchandrapur P. S. Case No. 738 of 2021 dated 03.01.2022 under Sections 420/406/409/34 of the Indian Penal Code.

And In the matter of: Azad Ali & Anr.

....petitioners.

Ms. Minoti Gomes, ...for the petitioners.

Mr. Rudradipta Nandy, ...for the State.

Petitioner prays for anticipatory bail.

Learned advocate appearing for the petitioner highlights the delay in lodgment of the police complaint.

Learned advocate appearing for the State submits that the petitioner is involved in the disbursement of public money. There is a huge amount of embezzlement of public money. Considering the gravity of the offence and the involvement of the petitioner therein and considering the materials in the case diary and considering the fact that the petitioner is involved in embezzlement of public money, we are unable to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

C.R.M. (A) 646 of 2022 is, thus, dismissed.
