The grievance of the petitioner is directed against an allotment made in favour of the private respondent in 1988. The private respondent is represented and refers to a letter dated 31st May, 1988 being Annexure P/5 (at page 25 of the writ petition).

In view of the admitted and indisputable position that the petitioner had prior knowledge of the allotment in favour of the private respondent as far back as in 1988, I am of the view that there is no scope of passing any order in favour of the petitioner. The grievance of the petitioner is belated, stale and is liable to be dismissed on the ground of inordinate, undue and unexplained delay on the part of the petitioner. Accordingly, W.P.A. 2709 of 2021 is dismissed.

There shall be no order as to costs.
