Report submitted by Ms. Debjani Sahu, learned advocate appearing for the State be kept with the record. Report encloses a self-declaration of the lady namely, Samapti Chatterjee. She has expressed her intention not to proceed further with Salanpur P.S. Case No.64 of 2022 dated 08.03.2022 under Sections 498A/323/406/506/34 of the Indian Penal Code so far as her husband and her family members are concerned. The criminal case referred to arise out of matrimonial discord and the same having been settled, I am of the view that
further continuation of the proceedings would result in miscarriage of justice. Accordingly, all further proceedings of Salanpur P.S. Case No.64 of dated 08.03.2022 under Sections 498A/323/406/506/34 of the Indian Penal Code including the charge-sheet therein is hereby quashed.
As the lady Samapti Chatterjee have expressed her willingness to withdraw the case against her husband and other family members, the order of quashing of the proceedings would extend to all the accused persons who have been implicated in connection with the instant case.
Accordingly, CRR 330 of 2023 along with CRAN 1 of 2023 is allowed.
Pending any other applications is consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
