1. This writ petition alleges inaction on the part of the 19.02.26 Sl-913 Ct.551 (S.R.) respondent State authorities taking steps against the respondent nos.13 to 15 despite representation being made by the petitioner indicating that the said respondent nos.13 to 15 are in unauthorized occupation of government/public land.

2. Learned advocate appearing for the petitioner submits that the respondent no.6 has been only passing the buck and has not been acting in accordance with law despite it being brought to his knowledge that the respondent nos.13 to 15 are in unauthorized occupation of government land.

3. Learned advocate appearing for the respondent nos.3 and 4 submits that the land, over which encroachment has been alleged, belongs to the Nadia Zilla Parishad and that, they have already informed the respondent no.6 about the said fact by a letter dated February 16, 2026.

4. Learned advocate appearing for the State respondents submits that she is yet to get instructions as regards the said letter dated February 16, 2026, however, the State respondents shall take steps, in accordance with law.

5. Learned advocate appearing for the respondent nos.13 to 15 submits that the allegations levelled by the petitioner are ill founded.

6. Heard learned advocates appearing for the respective parties and considered the material on record.

Since, it is evident from the material on record that the respondent no.6 has already been made aware about unauthorized occupation of government land both, by the petitioner, by way of several representations the latest thereof being dated November 6, 2025 (at pages 126 to 128 of the writ petition) as well as by the respondent no.4 i.e. Nadia Zilla Parishad by its letter dated February 16, 2026, the respondent no.6 should take appropriate steps to initiate appropriate proceedings in accordance with the applicable statute including the West Bengal Public Land (Eviction of Unauthorized Occupants) Act, 1962. The said respondent shall take expeditious steps to conclude such proceedings upon undertaking appropriate

enquiry and conducting spot verification as expeditiously as possible and preferably within a period of twelve weeks from the date of communication of this order, upon affording an opportunity of hearing to all interested parties including the petitioner and the respondent nos.13 to 15.

8. WPA 2537 of 2026 stands disposed of with the above observations. No costs.
