Sessions Judge, Diamond Harbour in Criminal Motion No. 368 of 2023, wherein the revisional application was dismissed. However, the revisdional application was preferred challenging the order dated 18th August, 2023 passed by the ld. JM, 3rd Court, Diamond Harbour, wherein the ld. Court was pleased to award maintenance.

I find from the impugned order passed by the ld. Revisional court that the amount of maintenance is Rs.2,500/- per month to be paid to the wife and Rs.1,500/- to be paid to the minor child aggregating to a sum of Rs.4,000/- per month.

Ld. advocate for the petitioner submits that, at present, the petitioner is unemployed.

Having regard to the quantum of interim maintenance so awarded, I am of the view, at this stage, there is no scope for interference.

However, the petitioner would be at liberty to take all the issues in course of the trial. The ld. Magistrate would at the end of the trial assess the evidence and arrive at its finding independently without being influenced by any of the observations made by this court.

With the aforesaid observations, CRR 419 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.

Under photostat certified copy of this order, if applied for, be supplied to the parties, subject to compliance with all requisite formalities.
