The present revisional application has been preferred against the order dated 23.08.2010 passed by the learned Judicial Magistrate, 2nd Court, Durgapur in connection with Misc. Case No. 123 of 2008.
By the impugned order filed in an application under Section 125 of the Code of Criminal Procedure, the learned Magistrate was pleased to award maintenance to the tune of Rs.3,000/- per month to the wife and Rs.2,500/- per month to the minor child (in total Rs.5,500/-).
The present petitioner being the husband was aggrieved and approached this Court.
I have taken into account the reason assigned by the learned Judicial Magistrate, 2nd Court, Alipore while arriving at the quantum of maintenance so awarded. Having regard to the present cost of living, I am of the view that there is no scope of interference by this Court. As such, the said order is affirmed. Accordingly, C.R.R. 192 of 2012 is dismissed. All pending applications, if any, are disposed of. Interim order, if any, is hereby vacated.
The learned Magistrate is directed to intimate the wife regarding the arrears and the same should be considered after a proper application is placed before the learned Court below.
The Department is directed to communicate this order to the learned Court below within seven days from date. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
