Matter relates to transfer of the petitioner on medical ground since petitioner is suffering from ailment. Last transfer application was made by the petitioner on medical ground on Utshasree portal on 19th September, 2022 and same was forwarded by the school authority where petitioner is presently working to the concerned District Inspector of Schools for taking further steps. The District Inspector of Schools (SE), South 24 Parganas on processing the transfer application of the petitioner forwarded the same to the West Bengal Central

School Service Commission through portal on 28th October, 2022.

Grievance of the petitioner is in spite of receipt of transfer application on 28th October, 2022, till date the Commission has not taken any decision.

Respondents are represented by learned advocates who have submitted that due to suspension of portal with effect from 29th September, 2022 timely decision could not be taken on transfer application.

In addition thereto, it is also submitted on behalf of the Commission that there was previous transfer application made by the petitioner on distance ground which was allowed by the State authorities but petitioner decided not to join the transferred post.

Having considered the submissions made on behalf of the parties and taking note of the fact that the transfer application was forwarded to the Commission on 28th October, 2022, the Chairman of West Bengal Central School Service Commission being respondent no. 3 is directed to take decision on transfer application of the petitioner by eight weeks from the date of communication of this order and decision to be taken by the respondent no. 3 shall be

communicated to the petitioner by ten days thereafter.

However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.

The writ petition stands disposed of, without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
