Both the review applications are taken up together for consideration.

R.V.W. 18 of 2021 has been filed by Durgapur Projects Limited on various grounds along with the ground no. IV, which reads as follows:- For that the learned court failed to take into consideration that the average of individual marks awarded by each of the members of the Interview Committee i.e. (1) Mr. M. Majumdar, MD & Chairman - SSC-1, 6+6+9+6.85, (2) Mr. B. N. Choudhury (Member), 10+6+9+6.85, (3) Dr. A. N. Biswas (Member), 10+6+9+6.85, (4) Mr. S. K. Jethi (Member), 6+6+9+6.85 could be taken into consideration. On December 3, 2021, we directed the Durgapur Projects Limited to produce the original records including the individual score sheet as well as the consolidated score sheet on the

adjourned date. In compliance of the said order, the individual score sheet as well as the consolidated score sheet are produced before us. On perusal of the record, we find that there is an error apparent on the face of the record and the contention of the Durgapur Projects Limited as stated in ground no. IV appears to be correct.

In view thereof, the application for review filed by Durgapur Projects Limited is allowed.

The writ petitioner has also filed a review petition on the ground that Durgapur Projects Limited in its review petition did not disclose the basis of the marks awarded by the interview board and that three of the candidates were given appointment although they got lesser marks.

In view of the fact that we allowed the appeal solely on the ground that the marks awarded to the appellant/writ petitioner is more than 60% of 50 marks allotted to him in the interview by the selection committee, which now turns up to be a wrong appreciation on our part and an error is apparent on the face of the record, we allow the review petition filed by the Durgapur Projects Ltd. keeping all other points open to be adjudicated at the time of hearing of the appeal Both the review applications are, thus, disposed of without any order as to costs.
