Mr. Tarique Quasimuddin Ms. Zainab Tahur ....for the petitioner This application under Article of the Constitution of India is at the instance of the decree holder praying for a direction upon the learned Civil Judge (Sr. Div.) at Tamluk to dispose of the Title Execution Case No.2 of 2015 expeditiously.

After going through the order sheets appended to this application this Court finds that a miscellaneous case under Section 47 of the Code of Civil Procedure is also pending. An application for amendment in connection with the title execution case is also pending. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge.

Since a J. Misc. Case under Section 47 of the Code of Civil Procedure is pending, CO 355 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.) at Tamluk to make an endeavour to dispose of the J. Misc.

Case No.30 of 2022 as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of J. Misc. Case No.30 of 2022 and any other miscellaneous cases that may be pending arising out of the title execution case the learned Executing Court shall make an endeavour to dispose of the title execution case as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.
