Case No. 357 dt. 17.10.2023, the petitioner preferred an anticipatory bail, where the findings of the court was to the extent that the nature of injuries which have been alleged do not reflect in the medical report as a grievous one.

I find that the allegations in the letter of complaint was assaulted by way of using hansua.

Ld. advocate submits that there is a counter case, wherein injury was sustained by the petitioners/associates of the petitioners. The investigation in respect of both the cases are in progress.

Accordingly, I do not intend to stall the proceedings or interfere with the proceedings.

However, the petitioner would be at liberty to approach this court after the report under section 173 of the

cr.p.c. is filed and the documents under section 207 of the cr.p.c. are handed over.

In case, the petitioners face inconvenience because of the cases pending, in that case, the petitioners would be at liberty to approach the ld. jurisdictional SDPO and/or Additional Superintendent of Police, who is in charge of Habibpur and inform the investigating officer regarding the inconveniences faced.

With the aforesaid observations, CRR 421 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.

Under photostat certified copy of this order, if applied for, be supplied to the parties, subject to compliance with all requisite formalities.
