Ld. advocate for the petitioner submits that the proceedings are under section 138 of the NI Act and more than one and the half years have passed, yet the examination under section 251 of the cr.p.c., till date, has not been completed.

Having regard to the plight so expressed by the petitioner, I am of the view that the same is justified. Accordingly, the ld. ACJM, Rampurhat is directed to overcome the stage of section 251 of the cr.p.c. on the next date so fixed.

In case, the accused person is evading the court, in that case, the ld. trial court would impose a bond which would be in the nature of a local surety. The examination of

Section 251 of the cr.p.c. be completed on the next date so fixed or within a month thereafter.

The ld. trial court would thereafter fix at least one date in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, CRR 420 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.

Under photostat certified copy of this order, if applied for, be supplied to the parties, subject to compliance with all requisite formalities.
