The Respondents/ Aliah University, produces instructions in Court today in compliance with the previous order dated 10th of April, 2023(supra). The instruction discloses the below par performance of the appellant in the admission process.

Let the instruction be retained with the record. A copy of the instruction is handed over to Mr. Ahammed, Learned Counsel appearing for the appellant.

Leaned Counsel appearing for the appellant submits before this Court that he is now instructed by his client not to proceed with the appeal.

Accordingly, MAT 150 of 2023 with CAN 1 of 2023 and CAN 2 of 2023 stand dismissed as withdrawn.

However, notwithstanding the withdrawal of this appeal, this Court observes that the Respondents/Aliah University shall conduct future recruitment and admission tests strictly in accordance with law. All parties shall act in terms of the copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for be given to the parties upon compliance with the necessary formalities.
