1. Learned Counsel for the appellants submits that the Respondent No. 1 has died in the month of October, 2023.

2. Accordingly, the appeal has abated.

3. However, learned Counsel for the appellants seeks to prefer an application for substitution after setting aside abatement on condonation of delay. If such an application is filed, liberty is granted to the appellants to mention the said application for inclusion in the list. As of today, FA 163 of 2022 and the connected application being CAN 1 of 2018 (Old No: CAN 1464 of 2018) stand abated, subject

to any order, if passed in connection with any substitution application.
