Mr. Arnab Mukherjee ... for the respondent no. 4 Mr. Shoham Sanyal ... for the CESC The grievance of the petitioner is directed against non-supply of a separate electricity connection at the premises.

On behalf of CESC Ltd., it is submitted that they were unable to carry out any inspection in view of the objections of the private respondent. On behalf of the private respondent, it is submitted that there is a dispute in respect of the right, title and interest of the petitioner in the premises. The petitioner claims a right on the basis of a probate certificate only in respect of the mezzanine floor of the premises.

In view of the fact that the petitioner claims an essential service i.e. electricity connection in respect of the mezzanine floor, there is no reason why the private respondent should resist an inspection by the CESC Limited.

In such circumstances, WPA 2532 of 2026 stands disposed of by directing the CESC officials to cause an inspection in accordance with law and after compliance with all statutory formalities

in respect of the connection sought by the petitioner. In carrying out such inspection, if there is any requirement of police assistance, CESC Ltd. is directed to take police assistance, if necessary, the payment for the police assistance would be borne exclusively by the petitioner. After causing such inspection, CESC Limited is directed to act in accordance with law and Rules framed thereon.

Since, no Affidavit has been filed, the allegations made in the writ petition shall be deemed to have not been admitted.

This order will not create any equity in favour of either parties in the pending suit. Liberty is granted to the CESC Limited to break open the padlock in case of any such adverse situation arisen in the premises. The private respondent is directed to give all necessary assistance in carrying out such exercise.

The CESC Limited is also directed to give a notice to the private respondent before causing any such inspection.
