According to the petitioner the private respondent has constructed his house in the sali land of the petitioner under the Bangla Awas Yojana. The petitioner has approached the Block Development Officer of the Indas Development Block highlighting his grievance by a representation dated 6th March, 2020. The petitioner alleges that the same has not been considered by the respondent authority till date.

None appears on behalf of the private respondents and the Pradhan of the Sashpur Gram Panchayat.

The petitioner prays for a direction upon the Block Development Officer for consideration of his representation.

As it appears that the petitioner has highlighted his grievance before the Block Development Officer by a representation way back on

6th March, 2020 and the same has been kept pending, accordingly this Court thinks it fit to dispose of the writ petition by directing the Block Development Officer, Indas Development Block being the respondent No.

herein to consider the representation made by the petitioner, strictly in accordance with the relevant scheme/circular/notification/guidelines after giving an opportunity of the hearing to the petitioner and the private respondent herein, at the earliest, but positively within a period of five months from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to all the parties immediately thereafter.

The petitioner is directed to forward a copy of the representation 06.03.2020 to the aforesaid respondent at the time of communicating the order of the Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
