The petitioner alleges that the respondent No.13 was illegally appointed, although the petitioner had been selected.

The documents relating to the selection of the respondent No.13 has been placed before the Court. The same are taken on record. It appears that the petitioner, the respondent No.13 and one Gita Rani Das were found eligible to be engaged as Accredited Social Health Activist (ASHA), upon verification of their documents as also upon police verification. As there was only one post, the

respondent No.13, who secured 62.3 marks in the total, was appointed.

The petitioner was empanelled as the second candidate and Gita Rani Das was the third candidate. The police verification of all the six candidates who had applied had been requested by the Sub-Divisional Officer, Contai, as per norms. The police verification in favour of the petitioner was also clear. The question of cancellation of the candidature of the petitioner did not arise as the petitioner was an eligible candidate to participate in the process and be empanelled. As she secured the second position, she was not granted the appointment. The respondent No.13 stood first and there was a single vacancy.

The writ petition is accordingly disposed of. There shall be no order as to costs.
