Mr. Sabyasachi Chatterjee Mr. Subhrajit Saha ..for the Petitioner Mr. Suman Ghosh Mr. Arka Mondal ...for the State Affidavit of service filed by the petitioner and report submitted by the State are taken on record. The petitioner is aggrieved by the notice issued upon him under Section 179 of the BNSS.

Heard learned counsels for the parties.

It appears that notice under Section 94 of the BNSS was issued upon the petitioner and the petitioner has produced certain documents before the Investigating Authority as called for.

It shall be useful to reproduce Section 179 of the BNSS.

"179. Police officer's power to require attendance of witnesses.- (1) Any police officer making an investigation under this Chapter may, by order in writing, require the attendance before himself of any person being within the limits of his own or any adjoining station who, from the information given or otherwise, appears to be

acquainted with the facts and circumstances of the case; and such person shall attend as so required:"

On perusal of the notice it appears that the same has been issued in terms of the provisions laid down under Section 179 of the BNSS.

The petitioner undertakes to comply with the said notice and appear before the Investigating Officer tomorrow, i.e., on February 04, 2026.

In view of the above, nothing further remains to be dealt with in the writ petition. The same is accordingly disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
