(Through Video Conference) Mr. Sabyasachi Mukherjee Ms. Arunima Das Sharma ....for the petitioner Mr. Jishnu Chowdhury, Ms. Manali Ali, Mr. Arka Chowdhury ....for the State-respondents The Assistant Commissioner of Police, Barrackpore Police Commissionerate has filed a report. The same is taken on record.
Counsel for the State shall circulate a copy of the report to the petitioner as well as the respondent nos. 5 and 6.
It appears from the report that a discreet enquiry was conducted on the allegations against the respondent no. 5 and no evidence was found. The only issue that remains is that the private respondent no. 6 has forcibly evicted the petitioner.
This Court cannot enter into the merits of the disputes between the petitioner and the private respondent no. 6. The parties are
contesting a Civil Suit and the same may be pursued before the Civil Court in accordance with law.
Insofar as the petitioner's allegations that the civil Court's order has not been enforced by the police, the ACP, Barrackpore Police Commissionerate has stated in his report that the orders of the Civil Court are indeed being complied with by the concerned Police Station. It is directed that the Assistant Commissioner of Police, Barrackpore Police Commissionerate shall monitor the functioning of the Dumdum Police Station insofar as the concerned orders of the Civil Court ensure the compliance thereof.
With the aforesaid directions, the writ petition is disposed of.
There shall be no order as to costs.
