We formally admit this appeal against an order dated 24th January, 2023 of the learned single judge refusing an interim order in the writ application (WPA 1437 of 2023 : Gunjan Sinha @ Kanishk Sinha -vsState of West Bengal and Ors.). In our view no purpose will be served in keeping this appeal pending to consider whether an interim order ought to have been passed or not. In the interest of justice it is better if hearing of the writ application is expedited.

Time to file the affidavit in opposition in the writ application is extended till 27th February, 2023. Affidavit in reply may be filed by 4th March, 2023. List the writ application on 6th March, 2023 before the appropriate bench subject to its convenience. We request the learned single judge to hear out the writ application as expeditiously as possible. The appeal (M.A.T. 152 of 2023) and the application (CAN 1 of 2023) are disposed of accordingly.
