Nag Mr. Avijit Chatterjee ..for the petitioner Ms. Usha Maiti Ms. Anita Khatri Mr. Sakya Maity ..for the opposite party This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 1st Court at Midnapore to dispose of Title Suit No.453 of 2022 expeditiously.

The learned advocate appearing for the petitioner submits that the title suit is otherwise ready for hearing. Ms. Maiti, learned advocate appears for the opposite party. She submits that the opposite party filed an application under Order 39 Rule 2A of the Code of Civil Procedure for violation of an order of injunction which is registered as J. Misc. Case No.156 of 2024. She prays for expeditious disposal of J. Misc. Case.

In the light of the submissions made by the learned advocate for the respective parties, C.O. 360 of 2026 stands disposed of by requesting the learned Civil Judge (Junior

Division), 1st Court at Midnapore to make an endeavour to dispose of the Title Suit No. 453 of 2022 and J. Misc Case No. 156 of 2024 as expeditiously as possible without granting any unnecessary adjournments to either of the parties provided the suit and J. Misc Case are ready for hearing.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
