The petitioner is aggrieved that in spite of being recommended to the presently vacant post of Accountant, which he has been occupying as Accountant (Acting) since January 3, 2025, he has not been appointed to the vacant post. 3.

Mr. Sudip Deb, learned senior counsel appearing for the petitioner submits that the college has taken a resolution on January 29, 2025 seeking approval for the appointment of the petitioner to the vacant post of Accountant, which has been duly forwarded as will appear from the letters dated February 28, 2025 and August 27, 2025 thereby, seeking prior permission from the respondent no.4 to enable the college to constitute a committee for the purpose of appointment of the petitioner. 4.

Mr. Subhrangsu Panda, learned counsel appearing for the College submits that even though the resolution and notices were sent to the respondent no.4, further steps by the Director

of Public Instruction, Education Directorate, Government of West Bengal has not been taken.

Mr. Swapan Kumar Datta, learned Government Pleader submits that by the letter dated September 25, 2025, the respondent no.4 has already placed the matter for the consideration of the concerned personnel of the Department of Higher Education, Government of West Bengal.

There has been a lapse of approximately six months. The college authorities have still not got any permission, which is mandatory to appoint the petitioner in the post of Accountant. 7.

I direct the respondent no.4 to pursue the matter with the competent authority of the Department of Higher Education, Government of West Bengal and obtain the prior permission from the said authority and intimate the same to the college authorities by March 20, 2026.

The college authorities are directed to ensure that upon receipt of such prior permission, a Selection Committee is constituted in accordance with law upon fulfilling all requisites and the appointment of the petitioner is made in terms of the rules and regulations and in terms of the resolution already adopted by the college by April 30, 2026.

With the afore-stated directions, the writ petition is disposed of.

Since no affidavits have been called for, the allegations made in the writ petition shall not be deemed to have been admitted.

There shall be no order as to costs.
