Roy ... for the Petitioner(s) Mr. Antarikhya Basu Ms. Debjani Sahu ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for six months eleven days for alleged recovery of 413 bottles of phensedyl. Additionally, it has been submitted that no recovery was effected from the present petitioner and the petitioner has been implicated solely on the basis of statement of other accused and witnesses concerned.

Learned advocate for the State, on the other hand, opposes the prayer for bail.

However, from the records, primarily, I do not find any connection either by way of CDR or any money trial concerned.

Considering the totality of the circumstances including the alleged recovery and that charges have already been framed, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Ajay Mandal @ Ajoy Mandal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court-cum-learned Additional District Judge, 4th Court, Malda.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Malda without prior intimation to the learned Special Court. Accordingly, CRM(NDPS) 221 of 2026 is allowed. Pending application(s), if any, is also disposed of. Report submitted be kept with the record.
