Khatoon ... for the Petitioner(s) Mr. Anand Keshari Mr. Debanik Das ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for nine months and the seizure in the present case is questionable as from the exclusive possession of the present petitioner, no recovery was made but the recovery was made from a vehicle.

Learned advocate further submits that the prosecution has implicated 12 witnesses and the case is being delayed as some of the accused persons are absconding.

Learned advocate for the State submits that commercial quantity of contraband has been seized. I have considered the circumstances of the case and I am of the view that the petitioner is in custody for a substantial period of time, as such, steps be taken by the learned trial court to split the trial of the case.

However, it would be, in the interest of justice, the learned trial court within a period of 90 days from the next date so fixed, exhausts the process of law for proceeding towards the next stage of the case.

Having regard to the quantum of seizure so made, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.

Accordingly, CRM(NDPS) 225 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
