Learned counsel for the petitioner contends that, despite having applied for a new electric connection, the petitioner has not yet got the same due to inaction of the CESC Limited.

Learned counsel appearing for the CESC Limited controverts such contention and contends that the petitioner applied for an industrial service connection; however, in view of an existing supply connection at the self-same premises, from which four connections have already been taken, including a domestic connection by the petitioner, no further similar connection can be given at the premises.

However, learned counsel for the CESC Limited further submits that, in the event the petitioner makes a

fresh application for a three-phased industrial connection at the premises, the CESC Limited is ready to supply the same to the petitioner, upon compliance of all formalities in that regard by the petitioner.

In view of the specific objection taken by the CESC Limited, which appears to be quite reasonable and in consonance with law, there is no option for the CESC Limited to give a new supply connection to the petitioner as per the petitioner's current application.

However, WPA 2215 of 2022 is disposed of by granting liberty to the petitioner to apply afresh for a three-phased industrial connection from the existing service line in the premises.

If applied for, the CESC Limited shall give such connection, subject to compliance of all formalities and deposit of requisite charges by the petitioner in that regard.

In the event such a fresh application is made, the present order will not come in the way of the CESC Limited in giving such connection.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
