The petitioner alleges unauthorized construction at the behest of respondent nos. 6 and 7. It is submitted that respondent nos. 6 and 7 have constructed a building on Plot No. 1300, J.L. No. 108, L.R. Khatian No. 1213, within Police Station Sonarpur, District South 24-Parganas. It is further submitted that the land in question belongs to the petitioner and that respondent nos. 6 and 7, without any right, title, or interest therein, have encroached upon a portion of the said land.

The learned Advocate appearing on behalf of respondent nos. 6 and 7 has produced before this Court a sanctioned building plan. It further appears that the classification of the land in question has been converted to bastu by the competent authority, and a conversion certificate

in that regard has also been produced. Let the sanctioned plan of the building and the conversion certificate be kept on record.

In view of the above, there is no substance in the allegation that the building has been constructed without any sanctioned plan from the Panchayat.

This Court, however, is not the appropriate forum to adjudicate upon the right, title, and interest of the parties. In respect of the civil dispute concerning the right, title, and interest of the parties over the land in question, the petitioner shall be at liberty to approach the competent Civil Court for redressal of such grievance.

Accordingly, WPA 2495 of 2026 stands dismissed. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Kausik Chanda, J.)
