Kausik (Allowed) CRM (M) 331 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliganj Police Station Case No. 449 of 2024 dated 02.06.2024 under Sections 143/341/302 of the Indian Penal Code and Sections 25/27 of the Arms Act.

Learned advocate appearing for the petitioners submits that petitioners are in custody for about 90 days and responding to the summons, the petitioners appeared before the Court as they were implicated on the basis of an order passed under Section 319 of the Cr.P.C.

Learned advocate for the State opposes the prayer for bail.

I have taken into account the conduct of the present petitioner who was initially not named in the charge sheet but responding to the summons, appeared before the Court.

Having considered the same, I am inclined to release the petitioners on bail.

Accordingly, the prayer for bail of the petitioners is allowed.

Accordingly, Petitioners, namely, (1) Turab Sk, (2) Sahaj Sk, (3) Sadar Sk shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional Sessions Judge, 1st Court, Krishnanagar, Nadia.

If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the Learned Special Court. Accordingly, CRM (M) 331 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
