Petitioner is aggrieved that he is not being allowed to operate his submersible pump because of the overt acts and obstruction created by the private respondents and on most occasions they disrupt the overhead electricity connections.

To that effect representation has been made before the police authorities.

State has submitted a report which reflects that long standing dispute is existing between the petitioner and the private respondents. To that effect Criminal Case being Patashpur PS case no. 87/24 has been registered for investigation and subsequently charge-sheet has been submitted.

The genesis of the present dispute is because of the demarcation of the land in issue. Consequently, the police authorities have drawn up proceedings under Section 126 of BNSS.

In view of the nature of the prayers advanced in the writ petition, I find that representation was made to the Superintendent of Police on 3rd of January, 2025. The Superintendent of Police through his authorized officers would dispose of the representation and communicate the outcome within a period of four weeks from the date of communication of this order at the behest of the petitioner.

With the aforesaid observations WPA 2483 of 2025 is disposed of.

Report submitted by the State be kept with the record.

A copy of the report be headed over to the learned advocate appearing for the petitioner. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
