This application has been taken out by Eastern and North East Frontier Railway Co-Operative Bank Limited being the respondent no.4 in the appeal for modification of the judgment and order dated October 18, 2023, whereby the appeal, being MAT 154 of 2023, was disposed of by this Bench.

By the order dated October 18, 2023, we had extended the time for completing the election of the remaining four Directors by eight weeks from that date. Today, further extension of time is asked for to complete the election process.

In spite of service of this application on the appellants, nobody appears for the appellants.

Mr. Nayak, learned advocate representing the Returning Officer says that time may be extended as prayed for and a direction should be passed on all concerned authorities to render full co-operation to the Returning Officer to complete the election process within the extended time period.

As prayed for, time for completing the process of election is extended by four months from date, keeping in view the ensuing Lok Sabha elections which may keep the Returning Officer otherwise engaged. We further direct that all concerned authorities shall extend all co-operation and render all assistance to the Returning Officer as and when so approached, in completing the election process in terms of the orders of this Court. The Returning Officer shall be entitled to take all steps in accordance with law.
