Mansoor Alam ...for the State The petitioner is aggrieved by order dated June 29, 2020 passed by the District Magistrate, Purulia. The said District Magistrate was acting in terms of an order dated November 7, 2019 passed in WP 12302 (W) of 2019 by a Co-ordinate Bench of this Court.

The petitioner's grievance is that he was entitled to remuneration from July 2015 to May 2018. The District Magistrate has found that the documents produced by the petitioner are false, fake and fabricated.

The petitioner has called upon this Court to compare the Attendance Register for the said purpose and to interfere with the findings of the D.M.

This Court finds that the petitioner has produced documents showing work done in the year 2020. No documents have been placed before

this Court in respect of the findings of the D.M. that the petitioner had not fabricated the documents.

The said findings are based on evidence and are not perverse. The Court does not see any arbitrariness in the findings or violation of principle of natural justice, in the decision making process.

In the event, the petitioner is desirous of challenging the findings of the D.M. in this regard, he may institute an appropriate civil proceeding. A writ Court cannot enter into a roving enquiry on the propriety of the findings of the District Magistrate.

For the reasons stated hereinabove, the writ petition must fail and is hereby dismissed.

There shall be no order as to costs.
