This revisional application has been filed by the defendant No.3 for expeditious disposal of the Title Suit No.14 of 2004 pending before the learned Civil Judge (Senior Division) at Purulia.

The order sheet reveals that adjournments have been prayed for by the plaintiffs and also by the defendant No.3. Reasons for such delay cannot be ascribed to the Court. Order sheet also reveals that dates have been fixed for examination of the learned Pleader Commissioner. It is submitted that the examination has not yet taken place.

However, this Court does not want to make any observation either on the merits of the suit either or on the present status thereof.

The revisional application is disposed of with a direction upon the learned Court below to expedite the hearing of the suit being Title Suit No.14 of 2004 pending before the learned Civil Judge (Senior Division) at Purulia and

dispose of the same within a period of six months from the date of communication of this order.

The learned Court below shall proceed independently and in accordance with law and without being influenced by any observation made hereinabove.

The learned Advocate-on-record for the petitioner is directed to serve copies of this revisional application upon the opposite parties as also the learned Advocate appearing in the learned Court below along with a server copy of this order within a week.

This revisional application is, thus, disposed of. There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
