For the WBSEDCL The grievance of the petitioner is for a direction on the respondent Distribution Company to adjust the amount of Rs.1 lakh paid towards the outstanding demand raised by the Distribution Company.

This is the second round of litigation between the parties. By an order dated 22nd February, 2019 the petitioner was directed to pay 40% of the amount. It is alleged by the petitioner that the petitioner has paid the said 40% of the amount in terms of the earlier order dated 22nd February, 2019. This fact is disputed by the Advocate appearing on behalf of the Distribution Company.

I have considered the submissions made on behalf of the parties. I find that the demand raised by the Distribution Company is for an amount in excess of Rs. 2 lakhs.

In view of the earlier order dated 22nd February, 2019 remanding the matter to RGRO,

I am of the view that there is no scope of passing any order in favour of the petitioner. The petitioner is directed to comply with the earlier order of this Court and raise all the grievances in accordance with law before the concerned RGRO within a period of 21 days from date.

With the aforesaid directions, W.P.A.

2808 of 2021 stands disposed of.

There shall be no order as to costs.

Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
