(Through video conference) Mr. Kaushik Chowdhury ...for the Petitioner Mr. Kanak Kiran Bandyopadhyy ...for the SSC Writ petitioner is one of the desirous candidates to be appointed in the post of Assistant Teacher in Secondary Section (Clases IX and X) and applied under the notification of First State Level Selection Test, 2016.

The petitioner participated in the written test and was subsequently called for verification (first phase). On verification petitioner was found not qualified due to insufficient qualification as it appears from Page 36 of the writ petition. Petitioner is aggrieved by such rejection of his candidature at the time of verification. Petitioner has prayed for permission to participate in the interview for being selected for the post of Assistant Teacher in Secondary Section.

Mr. K. K. Bandyopadhyay, learned Advcoate appears on behalf of the West Bengal Central School Service Commission and submits that interview for the post of Assistant Teacher in Secondary Section is already over. It is further submitted by Mr. Bandyopadhyay that selection

process is already completed and panel has been prepared. Therefore, there is no scope to grant opportunity to the writ petitioner to offer his candidature in the personality test/interview.

This Court has considered the submissions of the learned Advocates representing the parties to the writ petition and finds that though writ petitioner was allowed to participate in the verification process but his candidature was rejected on the ground of insufficient qualification in 2018. In the meantime, the selection procedure is complete upon preparation of the panel on the basis of personality test conducted by the West Bengal Central School Service Commission. The petitioner has prayed for participation in the interview/personality test which at this juncture cannot be allowed due to completion of the entire selection process; therefore, no relief is granted to the writ petitioner. WPA 1243 of 2018 accordingly stands dismissed. There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis.
