Petitioner is aggrieved by the fact that the respondent no.4 is misappropriating the fund in respect of the lease granted for pisciculture, for such wrongful act the police authorities were informed but they did not take any steps.

Learned advocate for the State submits that police authorities on receipt of the information has drawn up proceedings under Section 126 of the BNSS. Learned advocate for the private respondents submits that the property referred is a Wakf property and as such petitioner by informing the police authorities are trying to create a dominion over the property concerned.

Having regard to the nature of the facts involved as also the information furnished, I grant liberty to the petitioner to approach the jurisdictional Court by invoking the relevant provisions of law. Learned jurisdictional Court would decide the same by exercising his discretion.

In the meantime police authorities would oversee that no breach of the peace and/or tranquility takes place and/or any untoward incident results because of the strained existing between the parties. With the aforesaid observations WPA 2521 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
