We have considered the materials on record.

Petitioner was illegally excavating and transporting sand from an area which is not allocated for mining of minerals i.e. sand. Illegal sand mining is a menace and has serious far reaching consequences on ecology and flooding in the area. It partakes the character of an organized crime.

In such view of the matter, we are of the opinion this is not a fit case to grant anticipatory bail to the petitioner.
