Ct. 19 sg Mr. Shibaji Kumar Das Mr. Dipendu Sarkar ...for the petitioner Mr. Jahar Lal De, AGP Mr. Shamim-ul-Bri ...for the State Affidavit of service filed in Court is taken on record. The learned Advocate appearing for the petitioner, submits that during the pendency of this writ petition, the petitioner has been served with a order dated 6th February, 2026 thereby rejecting the prayer of the petitioner for restoration of mining operation. He further submits that in view of subsequent events, the petitioner wants to withdraw this writ petition with liberty to file afresh incorporating the subsequent events.

Mr. De, learned Additional Government Pleader, submits that the writ petition is liable to the dismissed on the ground of delay and laches.

However, since the petitioner is seeking leave to withdraw this writ petition, this Court refrains from making any comment in this regard.

On the prayer made by the learned Advocate for the petitioner, WPA 2516 of 2026 stands dismissed as withdrawn with liberty to the petitioner to file afresh on the self-same cause of action as well as by incorporating the subsequent events.

The respondents will be at liberty to raise all objections in case a fresh writ petition is filed.
