1. Affidavit-of-service filed in Court today be taken on record.
2. The petitioner is aggrieved that the private respondents are threatening to grab his land. There is one civil suit already filed by the petitioner in respect of another plot of land being Title Suit No. 636 of 2015 now pending before the learned Civil Judge (Junior Division) 1st Court, Barasat, North 24 Parganas against the private respondents in which he is enjoying an order of injunction.
3. The Inspector-in-charge, Duttapukur Police on their side have filed a report dated 24th February, 2023, which is kept with the record.
4. It appears therefrom that FIR No. 84 of 2023 dated 22nd January, 2023, 1240 of 2022 dated 13th December, 2022 and 40 of 2023 dated 9th January, 2023 have been registered by the police in which one charge-sheet being C.S. No. 174 of 2023 dated 11th
February, 2023 has been submitted and the other two FIRs are pending investigation.
5. It is, therefore, ordered that the investigation into the aforesaid two FIRs be completed as expeditiously as possible, preferably within a period of one month from date.
6. Since there is prima facie evidence before this Court of impropriety on the part of the private respondents, upon any further complaint of the petitioner, Duttapukur Police Station shall take coercive measures against the private respondents.
7. The Inspector-in-charge, Duttapukur Police Station shall, however, ensure that there is no breach of peace in the area.
8. With the aforesaid directions, the instant writ petition shall stand disposed of.
9. There will be no order as to costs.
