The subject matter of the present revisional application relates to an order dated 06.01.2023 as also the proceedings of the Criminal Revision No.9 of 2023. Petitioner approached this Court challenging the continuance of the revisional application being Criminal Revision No.9 of 2023 pending before the learned Sessions Judge, North 24 Parganas, Barasat.
I have perused the order dated 06.01.2023 passed by the learned sessions judge and I find that the subject matter related to a child who was staying with the father and there is a dispute between the couple. Consequently, the father made an application before the revisional court. The revisional court was in seisin of the mater. There was an interim order of stay of the operation of the order.
Since the child is in the custody of one of the parents, I am of the opinion that until and unless the revisional application is disposed of by the learned sessions court,
this Court will not interfere with the further continuance of the revisional application.
With the aforesaid observations, CRR 352 of 2023 is disposed of.
Pending application, if any, is consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
