2025-02-21Hon'Ble Justice Jay Sengupta2 pages

February 21, 2025 AD 34 Ct. 17 SG WPA 2614 of 2025 Lakshmi Bala Naskar (Gayen) alias Rita Naskar (Gayen) alias Lakshmi Bala Gayen vs.

The State of West Bengal and others Mr. Amit Bikram Mahata Mr. Tanistha Jain ... for the petitioner.

Mr. Bhaskar Prasad Vaisya Mr. Sagnik Chatterjee ... for the State.

Mr. Sarwar Jahan Ms. Mousumi Mitra Ms. Tapati Sarkar ... for the respondent No.5.

Ms. Koyeli Bhattacharyya Ms. Keya Panja ... for the WBBSE.

Affidavit of service filed in Court is taken on record. Learned counsel for the petitioner submits that the petitioner's name and date of birth have undergone changes. She made necessary affidavit in this regard and applied for consideration of correction of name and date of birth before the District Inspector of Schools on 18.09.2024, but the same has not been responded to as yet.

Learned counsel for the respondents denies the allegations and submits that it is a very strange case

where not only the name, but the date of birth was also allegedly required to be altered.

It appears from the two documents containing different names that the father's name has been mentioned as the same.

At this stage, learned counsel for the respondent No.5 submits that if the service record needs a change, then the application/representation has to be made before the respondent No.6.

In view of the above, the writ petition is disposed of granting liberty to the petitioner to make a fresh representation in this regard before the respondent No.6. If the same is made within two weeks from this date, the representation shall be considered by the respondent No.6 in accordance with law and expeditiously, preferably within six weeks from the date of receipt of such representation. Within a week thereafter, the outcome of such consideration shall be communicated to the petitioner.

With these observations, the writ petition is disposed of without any order, even as to costs. As affidavits were not called for, the allegations made are deemed not to have been admitted.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
