The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Dankuni Police Station Case No. 86 of 2019 dated 08-05-2019 under Sections 302 of the Indian Penal Code.

This is a renewal of the prayer for bail as the earlier application for bail was rejected on 5th June, 2020

passed in CRM 3753 of 2020 by a co-ordinate Bench of this Court.

It is an unfortunate case pertaining to the death of a lady in the hotel room and the minor baby of the lady was found crying.

It appears from the investigation that the petitioner took the said lady and the baby to the hotel and, therefore, the complicity of the present petitioner to the said offence cannot be ruled out at this stage.

Furthermore, we do not find any changed circumstances between the date when the earlier application for bail was rejected and the instant application has been filed. As such, the prayer for bail of the petitioner is rejected. With the aforesaid observations, the application for bail being CRM 1097 of 2021 is, accordingly, dismissed. (Harish Tandon, J.)
