Case No.49 of 2007, pending before learned Additional District Judge, 3rd Court, Burdwan, is the ultimate relief sought for in this case.

Admittedly, petitioner is the decree-holder. The Money Execution Case was instituted in the year 2015. It is contended by the learned advocate for the petitioner that till date, there has been no tangible progress towards logical conclusion of pending Money Execution Case.

Mr. Ganguly, learned advocate appearing for the opposite parties/State submits that an appeal has been preferred against the decision passed in L.A. Case No.49 of 2007, and the appeal is pending for hearing before this Court being FAT 439 of 2018.

That being the position, the instant revisional application be disposed of directing the court below to ensure expeditious disposal of the Money Execution Case, after having obtained appellate decision, so as to dispense with the justice in a best possible manner, but without granting any unnecessary adjournment, unless it is extremely unavoidable.

With this direction and observation, the revisional application stands disposed of.
