1. It is submitted on behalf of the petitioner that he is in custody for about 41⁄2 years. It is further submitted there is delay in trial. Accordingly, he prays for bail.

2. Report is placed on record. From the report it appears trial is at its fag-end. Date has been fixed for examining the accused under Section 313 of the Code of Criminal Procedure.

3. We have considered the materials on record. Allegations involve murder which if proved, would attract mandatory life imprisonment. Trial is at its fag-end. Date for examining the accused under Section 313 of the Code of Criminal Procedure has been fixed. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.

4. The application for bail is thus rejected.

5. Trial court is directed to expedite the trial and conclude the same at an early date.
