Mr. Arijit Ganguly, learned advocate appearing for the State has submitted a report before this Court, which reflects the investigating agency has no objection if the vehicle being Registration No. NL02N/3855 is returned to the registered owner of the vehicle.

Records reflect that the case is pending before the learned Additional District and Sessions Judge (1st Court), Raiganj, Uttar Dinajpur/Special Court (E.C Act), Raiganj, Uttar Dinajpur. Petitioner being the registered owner, is directed to communicate this order to the ASI, Safikul Islam, Dalkhola Police Station, Islampur Police District. An application be filed enclosing this order before the learned Special Court in seisin of the matter. Learned Special Court would impose appropriate conditions for release of the vehicle. Whole of the process must be completed

within one week from the application filed before the Special Court by the present petitioner, who claims to be the registered owner.

Report so submitted be kept with the record.

A copy of the report be handed over to the petitioner by the learned advocate appearing for the State.

With the aforesaid observations, C.R.R. 355 of 2023 is disposed of.
