Dr. Sailendra Narain & Anr.

Versus

Dayco Commodity Brokers Private Limited & Anr. The revisional application has been preferred challenging the proceedings relating to Complaint Case No.CS-0030347/2015 pending before the learned Chief Metropolitan Magistrate, Calcutta. The foundation of the revisional application has been built up on photostat copies of certain documents along with certain question of facts which include the age of the present petitioners.

Having regard to the issues so raised, I am of the opinion that the petitioners would produce the original copies before the learned Magistrate/trial court at the appropriate stage of the proceedings for the trial court to consider the contentions. So far as the issue of age is concerned, the learned trial court may allow the petitioners to represent them through their learned counsel on proper undertaking with prayers for exempting their personal appearance from day-to-day proceedings.

With the aforesaid observations, CRR 34 of 2016 is disposed of.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
